These Terms constitute a legally binding agreement between you ("Customer," "you," or "your") and YesNet ("Company," "we," "us," or "our"). You represent that you are at least 18 years of age and have the legal capacity to enter into this agreement.

2. Service Description

YesNet provides high-speed internet connectivity services through various technologies including fiber-optic, cable, and wireless networks. Our Service includes:

  • Internet access at specified speeds based on your selected plan
  • Email accounts (where applicable)
  • Customer support services
  • Access to customer portal and account management tools
  • Optional add-on services as selected

Service features, speeds, and availability may vary by location and are subject to technical limitations and network capacity.

3. Account Registration

To use our Service, you must register for an account and provide accurate, current, and complete information. You agree to:

  • Provide truthful and accurate registration information
  • Maintain and promptly update your account information
  • Maintain the confidentiality of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access or security breach

We reserve the right to suspend or terminate accounts that contain false or misleading information.

4. Service Plans and Pricing

4.1 Available Plans

We offer various service plans with different speeds and features. Current plans and pricing are available on our website and may include:

  • Basic Plan: Up to 100 Mbps
  • Standard Plan: Up to 500 Mbps
  • Premium Plan: Up to 1 Gbps
  • Business Plans: Custom speeds and SLA

4.2 Promotional Pricing

Promotional rates are available for new customers and are subject to terms and conditions specific to each promotion. After the promotional period ends, regular rates will apply.

4.3 Price Changes

We reserve the right to modify prices with 30 days' advance notice. Continued use of the Service after price changes constitutes acceptance of the new pricing.

5. Payment Terms

5.1 Billing Cycle

Services are billed monthly in advance. Your billing cycle begins on the day your service is activated. Partial month charges may apply for mid-cycle activations.

5.2 Payment Methods

We accept the following payment methods:

  • Credit cards (Visa, MasterCard, American Express, Discover)
  • Debit cards
  • ACH bank transfers
  • Electronic checks

5.3 Automatic Payments

By enrolling in automatic payments, you authorize us to charge your selected payment method each billing cycle. You may cancel automatic payments at any time through your account portal.

5.4 Late Payments

Payments are due on the billing date. Late payments may incur a fee of $10 or 1.5% of the outstanding balance (whichever is greater). Service may be suspended or terminated for accounts more than 30 days past due.

6. Service Availability

6.1 Service Level

We strive to provide 99.9% network availability. However, actual speeds and service availability may vary based on:

  • Network congestion
  • Customer equipment and configuration
  • Physical location and environmental factors
  • Content provider limitations
  • Maintenance and upgrades

6.2 Maintenance

Scheduled maintenance is typically performed during off-peak hours. We will provide advance notice of scheduled maintenance that may affect service availability.

6.3 Service Interruptions

We are not liable for service interruptions due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, labor disputes, or third-party failures.

7. Acceptable Use Policy

You agree to use our Service only for lawful purposes and in accordance with these Terms. Prohibited activities include but are not limited to:

  • Illegal activities or promotion of illegal activities
  • Transmitting malware, viruses, or harmful code
  • Spam, phishing, or fraudulent activities
  • Copyright infringement or intellectual property violations
  • Network attacks, hacking, or unauthorized access attempts
  • Excessive bandwidth usage that degrades service for others
  • Running servers or services without authorization
  • Reselling or redistributing service without permission

Violation of this policy may result in immediate service suspension or termination without refund.

8. Intellectual Property

All content, trademarks, service marks, logos, and intellectual property displayed on our website or through our Service are the property of YesNet or their respective owners. You may not:

  • Copy, modify, or distribute our content without permission
  • Use our trademarks or logos without written consent
  • Reverse engineer or attempt to extract source code
  • Remove or alter any proprietary notices

9. Privacy and Data Protection

Your use of our Service is subject to our Privacy Policy, which is incorporated by reference into these Terms. By using our Service, you consent to our collection, use, and disclosure of information as described in our Privacy Policy.

We implement reasonable security measures to protect your personal information, but cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials.

10. Disclaimers and Limitations of Liability

10.1 Service Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YESNET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE SERVICE.

10.3 Maximum Liability

Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount paid by you for the Service in the three (3) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless YesNet, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:

  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your use or misuse of the Service
  • Content you transmit through the Service

12. Termination

12.1 Termination by You

You may terminate your service at any time by:

  • Contacting customer support at 870-270-4087
  • Submitting a cancellation request through your account portal
  • Providing written notice to our business address

Termination will be effective at the end of your current billing cycle. No refunds are provided for partial months unless required by law.

12.2 Termination by Us

We may suspend or terminate your service immediately for:

  • Violation of these Terms or Acceptable Use Policy
  • Non-payment or payment disputes
  • Fraudulent or illegal activity
  • Court order or legal requirement

12.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. You remain responsible for all charges incurred up to termination. Equipment rental fees may apply until equipment is returned.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the State of Arkansas, without regard to conflict of law principles.

13.2 Arbitration

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except where prohibited by law.

13.3 Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via:

  • Email to your registered address
  • Notice on our website
  • Your account portal

Continued use of the Service after changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must discontinue use of the Service.

Additional Provisions

Entire Agreement

These Terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and YesNet regarding the Service.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver

No waiver of any term or condition shall be deemed a further or continuing waiver of such term or any other term.

Assignment

You may not assign or transfer these Terms or your rights under them. We may assign our rights and obligations without restriction.
